It would appear the BCCI want blood out of the stone and if this runs its full course could be the death knoll for West Indian cricket.

USD42M! There is no way that the West Indies Cricket Board have access to that amount of money. Even if they paid it back in instalments over a 5 year period there would still be interest to pay. It leaves West Indies cricket staring into an abyss.

The world has changed somewhat. I don't remember the Indians and the MCC getting into a legal bunfight over the cancellation of the England tour in 1989, when the issue was the selection of Graham Gooch, who had broken the UN sporting embargo of South Africa. Neither do I recollect there being a court case when the South Africans called off the 1970 England tour because the MCC had selected Basil D'Oliveira to be in the touring party; but the South Africans paid dearly for this decision and were excluded from genuine international cricket for nearly a quarter of a century.

I wonder exactly what court would be competent to hear this case. If it is an Indian court, how will it convince the world that the judgment was unbiased? Also, how will it enforce any financial penalty against a body which operates in the West Indies? The Board of Cricket Control India has indeed been wronged here and the West Indies are in the wrong and should indeed be punished for this. But there is a limit to what is sensible and fair and on the face of it the BCCI is grossly exceeding that limit. This may of course be an opening gambit to put the Fear of God into the WCCI and make them feel extremely keen to negotiate this shit away. If so, that's fair enough.

Had these occurred in the current day some form of financial compensation would have been sought as is the norm these days for anything from an accident to slander.

I fear any court case would be in favour of the BCCI, who would probably not see a penny of the financial award. However given the power the BCCI weald it would be of no surprise if they were able to force a world wide ban on the West Indies through the ICC.

The West Indies would also be hit hard with no further fixtures against India, which would leave them seriously out of pocket and struggling to exist financially.

These day international tours are awarded, organised and financed through a business procedure. With high finance involved comes the legal contracts - just like in any business venture. The BCCI do have the legal muscle to, at the very least, embarrass the WICB financially. How determined will they be to receive this compensation? This case could end up being heard in the High Court in London.

Fair point. There will certainly be a signed contract and in the contract there will certainly be a clause stating which country and which court shall have jurisdiction in the event of a breach of contract. I note that Ian Bishop, the former West Indian fast bowler, has commented on the naivety of the West Indian players in withdrawing their labour without considering how far reaching the consequences would be. But perhaps the WICB should also have reflected that the players need to be compensated for their labour and that a strike would threaten the very existence of West Indies as a test "nation".
