I was married at 17 and my then wife was 16. I had lots of pictures of her topless and fully nude in sexy poses, so under this legislation I could be prosecuted for looking at pictures or even possessing images of my own wife. So to quote Mr Bumble from Dickens Oliver Twist, "the law is an ass".

I dislike the fact that a copy of, say, Mayfair I bought in the 70s with a sixteen-year old in has now become illegal as much as you all do. But the law isn't applying retrospectively. It criminalises the possession of such an image now; no-one can be prosecuted for making such an image at a time when it wasn't illegal.

There's a defence possible in this case.

Marriage and other relationships

(1) This section applies where, in proceedings for an offence under section 1(1)(a) of taking or making an indecent photograph of a child, or for an offence under section 1(1)(b) or (c) relating to an indecent photograph of a child, the defendant proves that the photograph was of the child aged 16 or over, and that at the time of the offence charged the child and he—

(a) were married, or

(b) lived together as partners in an enduring family relationship.
