It's A Wonderful Life fell under this. But the copyright owner took corrective steps and regained protection. But it would be doubtful that the majority of porn producers did this.

It depends on which country you live in. Copyright laws are not the same everywhere.

I Denmark you can only freely use material that exceeds 100 years. Meaning everything from 1907 and backwards is now out of the copyright protected area.
In other countries the copyrights is 50 years after the owners death. That could even be a longer time period before it is released for everyone to use.

But there is only one law above them all: Money

If nobody cares you will get away with using the material.

Always follow the money (sadly enough).

BV probably started in seattle. It seams a small business sprung up to convert customers 8-mm movies to VHS tape. The business found that porno was the dominant business (go figure) and kept a copy of the konverted porn. Circa 1990 nobody seemed to care much about copyright of this old stuff so the small business proceeded to sell VHS. Albeit, the tapes were rapidly strung together. Then some nasty sue happy asshole(s) from calipornia shut the little business down.

But the brand proved too strong. Folks like those here, began to share AVI files. The sue happy jerk(s) finally realized the internet was passing them by and laughing at them. Some sort of deal was struck, and the tapes have all been konverted to DVD disks and all for sale again.
