Might as well discuss this since England ODI victories will soon get tedious

Now if the legal rep for Stokes has a brain he/she would recc that he pleads guilty. That, itself, should ensure that the matter never gets beyond 'the beak'. Except that the same legal rep did not think that it would ever get this far.

But Stokes if he is bloody-minded, and his statement states that he wants to 'clear his name' and that, in my mind, suggests that he will enter a not-guilty plea, somewhat forces the judiciary's hand.

Notable that the pic of that infamous night out was published again today. Five persons and only one not even attempting a smile. In fact another pic with his now wife was also published and he can not even raise a smile there. In my eyes that says a lot of his character.

Over to you ECB.

Now I am confused.

The ECB has announced that Stokes will be available for selection in the NZ part of the current tour.

But what is the difference here ? Whilst under investigation they would not select him but now he has been charged they will. Double standards ?

Does beg the question why knowing the general circumstances they didn't pick him for the tour in the first place!

But can you imagine the scenario that Stokes arrives in NZ only to be served notice that he has to appear before the beak. Would not go down well if he does not appear in person.

The ECB has argued that the time to 'trial' is, at present, indeterminate. Which is so. But it was equally so some months back when the incident arose.

They, it does appear, did not want the bad publicity to follow then all over Oz. But then they never expected the incidents that happened on the tour either.

And what happened to the disciplinary procedure ?

Also reported today that the ECB are running scared.

Scared that Stokes could, in the interim, sue them for restrain of trade. Even more inconsistency. They allowed him to play in NZ whilst the Ashes were on. They, I believe, have allowed him to be available for the ICL. Add to the apparent fact that he, Stokes, is still on full pay by virtue of his central contract.

A parallel was drawn today of a footballer a few years ago in a similar situation who was never selected for England until his case trial was concluded. This, surely, sends out the wrong message since the good of the game should be bigger than one individual.

By some wonderful coincidence the date for the magistrates' court has been set.

13th February which happens to be the date of the first 20/20 in NZ.

Now I hardly see Stokes' legal brief successfully arguing for the date to be put back to accommodate a cricket schedule since that, these days, is also indeterminate.

One can just hear the egg being cleaned off the ECB's faces

What ever happened to innocent until proven guilty?

Possibly lost a little of the usual effect with the release of video evidence that clearly shows him instigating violence rather than using acceptable self-defence. Unless of course the video evidence is contrived...

No issue with him defending 2 gay blokes against homophobic taunts and slurs, though usually that doesn't require crossing the street to smash people.

In someone sober & thinking clearly, normal response to taunts and slurs would be to assist them out of the danger area to ensure violence did not occur or escalate, asking the establishment's security team for help and calling the police in.

If an assault on those 2 men was already underway, then trying to stop it would also be acceptable.

After all then hype of the first ODI victory, what's the betting England will disappoint in the early hours of tomorrow.

All the batsmen (except maybe Root) will go out to bat with all guns blazing hoping one off them will come off.

Meanwhile Aust will show a lot more resolve and will not be surprised by Wood, Rashid, Plunkett...

A pathetic effort by our bats at the Gabba. England should mow this total down with many an over to spare.
