If the laws in the US allow immigrants at our borders to apply for asylum - why is there so much arguments/fears if asylum seekers do that? https://www.americanimmigrationcounc...-united-states

Congress should change the law if they are so upset about it. As far as I can read it, the caravan migrants are following our laws.

Asylum is a protection granted to foreign nationals already in the United States or at the border who meet the international law definition of a “refugee.” The United Nations 1951 Convention and 1967 Protocol define a refugee as a person who is unable or unwilling to return to his or her home country, and cannot obtain protection in that country, due to past persecution or a well-founded fear of being persecuted in the future “on account of race, religion, nationality, membership in a particular social group, or political opinion.” Congress incorporated this definition into U.S. immigration law in the Refugee Act of 1980.

Apparently US judges in New York vary greatly from judges in Atlanta. 75% allowance to 10% allowance is a showing of subjective interpretation. The US should get consistent on this matter.

And I agree with Lutz about Germany. I have read their citizenship law several times; the quotation you cited from the Center for Immigration Studies is both over-simplified and wrong. Somewhere upstream in this thread I asked if there was anyone who could explain it to me, because it is incredibly complex. In part citizenship depends on when and where a person was born and the nationality of one's grandparents. For example, your post does not address the Swiss exception to German citizenship.

It's complicated. That is a national average. In states that do not have laws to suppress voting the turnout averages 40% or more. In states that used to have laws that prevented non-whites from voting, mostly southeastern and Midwestern states, those laws have been replaced by a series of complex gimmicks that make it very difficult for non-whites to vote, so turnout is less than 30%.

Much easier said than done.

First, despite the commonly-used title, and despite the fact they wear robes, they are not judges. They are employees of the Department of Justice and take instruction from their supervisors. The vast differences in the rates of granting asylum are the result of supervisor preferences.

Second, virtually all the cases that come before them have already been investigated by the D.o.J. and determined to meet the criteria for asylum--A "well-founded belief that they will be killed or suffer great bodily harm" if returned.

One area of policy dispute within the D.o.J. is whether the threat of death or great bodily harm must come directly from the foreign government, or can be inferred from the foreign government's unwillingness or inability to protect them. When I was practicing one of my worst cases was a Mongolian (I represented mostly Asians, given that I worked in Seattle) who had organized a group of small landowners who were resisting government collectivization. He had been stabbed after making a speech. When he was released from the hospital he fled to the U.S. and reported to the Border Patrol. At his trial we could not establish the identity of the person who had stabbed him, and we had a judge who insisted that asylum would only be granted if direct government involvement could be proved. He was deported. We were in touch by email, so I know he survived the Ulan Batar airport, but after two weeks I heard no more from him.
