No, I think you can blame Neil Gorsuch being on the SCOTUS on Joe Biden. His totally unnecessary monologue in June of 1992 is what opened the door for McConnell and crew to hold up the nomination. I really do not see how they would have gotten away with that otherwise. They might have tried but it would have been much more difficult and politically damaging in an election year. If they had tried and succeeded and the Dems spun it properly it might have been enough to push HRC over the top. Did you notice how Obama and the WH rolled over and played dead without a peep? They had no choice. Their sitting veep was responsible. By rights, I feel that should have been Obama's vacancy to fill. It's astonishing that a relatively benign speech twenty five years ago can come back to haunt you.

I'm also pretty confident that had the justices foreseen a Trump victory in 2016 that we might have seen a few retirements in 2014-2015. Anthony Kennedy has been rumored to have been considering it lately and Ruth Bader Ginsberg is not in very good health.

There is very little of the Constitution that is truly black and white. I believe part of that was intentional while some of it is just a product of dealing with a document written 250 years ago. Even the parts that are black and white are spun in the same fashion as the vague sections. If it were so black and white we really would not need a SCOTUS or at least we would already know their rulings before they are delivered.

We have a representative government. We elect people to positions who support and believe in the things we believe in and feel are important. They make appointments based on those same beliefs (in theory, anyway). When was the last time your utopian model for the SCOTUS actually existed - if ever? Every judge has a track record. Where are do you find these totally impartial judges that read things right down the line that you allude to? There was likely the same partisan bickering taking place as the Constitution was being drafted and refined.
