FileFactory's Acceptable Use Policy

2. NO COPYRIGHT INFRINGEMENT
You must only upload files you are legally entitled to reproduce, publish, or distribute. By uploading a file, you warrant that you own or are otherwise legally authorised to share the file.
We take allegations of copyright infringement seriously. If you are aware of infringing material, please report it in accordance with our Copyright Policy.

4. CONTENT RESTRICTIONS

You must not upload, share, or distribute any files, comment, or link to any material that contains any of the following:

Any content that is illegal (including any content refused classification) in your country any location our servers are based from time to time;

Any content that may adversely affect our commercial reputation, brand and goodwill;

Any virus, malware, trojan, or intentional security vulnerability;

Child exploitation material, or any promotion of paedophilic activity;

Materials that instruct, promote, incite or support, or enable any in crime, violence or terrorism;

Materials that promote, incite or support discrimination or hatred of a person or group;

Pornographic, indecent or abhorrent content including but not limited to rape (or simulated or implied rape), bestiality (sex involving animals), drunken content (or simulated or implied drunken sex), incest (or simulated or implied incest), forced sex (or simulated or implied forced sex) depicted in but not limited to images and videos (including anime and cartoons) regardless of whether participants are willing or paid actors;

Spam, promotion, advertising or any unsolicited communication.

Any suspected illegal activity may be reported to the relevant authorities. FileFactory reserves the right to apply a fine of USD$25,000 per instance.

8. Acceptable Use
You agree to not use FileFactory.com's Service:
a. in any way contrary to our Acceptable Use Policy;

b. to upload, post, email, transmit or otherwise make available any Content that spreads messages of terror or depicts torture or death-images; if appropriate, the content will be reported to the appropriate legal authority and/or the member's ISP will be contacted;

c. to harm minors in any way, this includes any form of child pornography; if appropriate, the content will be reported to the relevant legal authority and/or the member's ISP will be contacted;

d. to upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; on this matter, please refer to FileFactory.com's DMCA Policy, which is herein incorporated by reference;

8.1 Illegal Content

FileFactory.com neither sanctions nor permits site content or the transmission of data that contains illegal or obscene material or fosters or promotes illegal activity, including but not limited to, gambling, the offering for sale of illegal weapons, and the promotion or publication of any material that may violate hate crimes legislation.

FileFactory.com reserves the right to immediately suspend or terminate any account or transmission that violates this policy, without prior notice.
Further, should Customer violate this policy, FileFactory.com will actively assist and cooperate with law enforcement agencies and government authorities in collecting and tendering information about Customer, Customer's site, the illegal or obscene content, and those persons that may have inappropriately accessed, acquired, or used the illegal or obscene content.

8.2 Wrongful Conduct

Customer shall not commit or permit wrongful or damaging acts which justify civil action including, but not limited to, posting of defamatory, scandalous, or private information about a person without their consent or intentionally inflicting emotional distress.

8.3 Access and Interference

Violations or attempts to violate FileFactory.com systems or to interrupt FileFactory.com services are strictly prohibited, and may result in criminal and civil liability. Examples of system violations include, without limitation:
(a) Unauthorised access to or use of FileFactory.com Services, including any attempt to probe, scan or test the vulnerability of a system or to breach security or authentication measures without express authorisation of FileFactory.com; or (b) Interference with Service to any customer or network including, without limitation, flooding, or deliberate attempts to overload a system and broadcast attacks; or (c) Use of any device, software, or routine to interfere or attempt to interfere with the proper working of the Services; or (d) Any action that imposes an unreasonable or disproportionately large load on FileFactory.com's infrastructure

Customer shall not decompile, disassemble, decrypt, extract, reverse engineer or otherwise attempt to derive the source code of the "software tools" (including the tools, methods, processes, and infrastructure) underlying the Services or any other software on the FileFactory.com Web site.

8.4 Copyright or Trademark Infringement

FileFactory.com Services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation, including export control laws, is prohibited. This includes, without limitation, material protected by patent, copyright, trademark, service mark, trade secret or other intellectual property rights. If you use another party's material, you must obtain prior authorisation. By using the Services, you represent and warrant that you are the author and copyright owner and/or proper licensee with respect to any hosted content and you further represent and warrant that no content violates the trademark or rights of any third party. FileFactory.com reserves the right to suspend or terminate a Customer's transmission(s) that, in FileFactory.com's discretion, violates these policies or violates any law or regulation. FileFactory.com's DMCA Policy, which is herein incorporated by reference, has further important details on this matter.

8.5 Misuse of System Resources

Customer shall not misuse system resources including, but not limited to, employing content which consume excessive CPU time or storage space; utilising excessive bandwidth; or resale of access to content hosted on FileFactory.com servers. Please refer to our Fair Use Policy for additional information.

8.6 Other Activities

Whether lawful or unlawful, FileFactory.com reserves the right to determine what is harmful to its Customers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the Service or the Internet.

Please be aware FileFactory.com reserves the right to cancel any account or transmission they find in violation of any of the above policies. If appropriate, FileFactory.com will refer complaints to law enforcement authorities, and in such case, FileFactory.com will actively assist law enforcement agencies with the investigation and prosecution of any such activities, including surrendering Customer account and data information.

Complaints about violators of our Policy should be sent via e-mail to abuse@filefactory.com. Each complaint will be investigated and may result to immediate cancellation of Services without prior notice.


I'm struggling to think of ANY content linked to on VEF that isn't in violation of those T&Cs.

Fully clothed public domain or otherwise out of copyright images of celebrities is all I can come up with.

I think that's written solely for the benefit of FileFactory, all the stuff about terror images and hate crime legislation smacks of that.
